what should i do?

I was surfing the net today and i came upon a site that looks like a carbon copy of mine. Everything is the exact same. The colors, text, links...etc. The only difference of course is the logo. I do not know what to do. my biggest fear is of course getting penalized by search engines. I tried to do some reverse lookups on the persons phone number to have the stop this but no luck. All the whois information seems to be somewhat made up. What should i do?

File an infringement complaint with Google and their ISP (if in the US).

[google.com...]

If they have a US host, check the host's site for the procedure to file a DMCA complaint. If they don't have one posted, write them and ask for it.

Late reading this post but one question comes right to mind...

How did you get YOUR design? Did you personally make it? If not did you buy it? If so did the creator state they would NOT resell the template?

Just some thoughts.
