Brand name copyright?

Hello,

I have a net biz in mind that has a very distinguishable name. It contains several words.

However, how would I begin to legally protect the business name and my unique name brand of product?

Also, how would one copyright a website if the content is always changing?

One trademarks names and copyrights content.

Copyright protection is automatically active the moment you publis something; you do not even need to indicate "Copyright ©2004" any more for it to be enforceable. In the US, copyright is overseen by the Library of Congress (www.copyright.gov).

Trademark protection is also automatic, but subject to stiffer rules regarding its use before the protections kick in (e.g. how long and how consistently you've used the name, whether or not it is unique enough, etc.). You can use ™ (or sm) to indicate that you intend to defend your exclusive use of a name. For a fee, you can register the name and/or logo with the Patent and Trademark Office (PTO, www.uspto.gov), which will give you the right to use the ® mark and indicates government acknowledgment of your exclusive riht to the name/logo.

If your site changes frequently and you are concerned about content theft, you might want to document past versions by saving old files, keeping backups, maintaining a file of printouts, etc. The best technique will depend on the size of the site, frequency of major changes, etc.
