Also, be sure to check the host's Terms of Service so that you can also include a reference if they explicitly prohibit such behavior by their clients.
Address the e-mail to the appropriate department to ensure it gets to the right people (ie, an abuse reporting address, or administrative, rather than sales or technical support). This is much appreciated by staff.

I would also cc the email to the webmaster of the offending site (assuming they have an email addy).
Doing that may be just enough to get them to remove it fast, especially if the ISP has a policy on this.
