Like this:
Infringing domain hosted on NS also owned by the same Infringers.
So how do I trace the upstream host of the nameserver to send them a DMCA?
No copyright agents listed for either domain (of course).
The site has been shut down previously in response to somebody else's DMCA so it should work, once I trace them.

To find the host, ping the domain name. This will return an IP address. Do a whois search on the IP to find who owns that block. Poke around that site to find their copyright policy, and send the notice to them.
The nameserver is pretty much irrelevant to the issue of copyright infringement, to my knowledge.

Now that is new to me. You mean enter their IP into a whois search, and send a DMCA to the owners of their IP BLOCK.
That sounds useful, previously I've only DMCA'd infringer's hosts.

The infringer's IP results in a whois like this:
Netblock: 12.34.56.0/25
NetUse : loopback ips for 98.765.432.10
Coordinator:
WebHost WebHost abuse@example.com
The WebHost example.com merely shows the default Plesk page in a browser, so I assume that is the infringer's own server. Correct?
But when I do a whois on the
NetUse : loopback ips for 98.765.432.10
I find that is nac.net, a biggish US IP who have a page to report abuse etc.
Would they be the ones to contact and DMCA about this?
Or is there somebody below them who'd be the next to contact?

I've already DMCAd nac.net about the infringing site, so I'll wait to hear from them first.
They seem to have a fairly 'responsible' abuse policy, so if the infringing site is using the NAC pipe, it will be acted on.
