I am having some difficulty with one of my clients paying her bills.
I developed an ecommerce site for a client but since the site was launched 2 years ago she has not paid me for hosting the site (even though the hosting was included in the contract).
Now, another "web desing company" has asked me for her ftp details, but I am reluctant to give anyone access (due to her not paying for hosting fees). I have sent her reminders for payment, but heard nothing.
Does anyone know who actually owns the source/templates/databases for her site? I'm not really up on my intellectual property, but would like to send her a letter saying she has 14 days to pay up or her site will be removed/deleted from my servers.
Can I do this? My lawyer knows nothing about Intellectual Property and I dont want to fork out even more money for one who does..
Any help would be appreciated!
Since she hasn't paid for 2 years, I'm surprised you haven't cut her off long before now!
Unless your contract states otherwise, I suggest sending a registered/certified letter with return receipt (so you have proof that she actually received it) giving her X days to pay or the site will be turned off. Also say that outside FTP access will be denied until payment has been received in full.
