Do you have any caselaw for this? I don't recall seeing anything definitive yet.
Whether the offending website content displays an image that is physically located on the OP's website, on the offending website server itself, or on some other webserver should not be of consequence as long as the OP has copyrights on that image. The act of changing the underlying src attribute of the img tag has not changed the fact that they are displaying copyrighted material without permission.
