Website with same title as Book

Book published before website was started

Are there any issues surrounding a website and a book having the same title/domain?

Assuming that the website is well established but that the book was first published well before the website went live, I would like to know is whether or not the book publisher (or the author) could force the website to change its name or lay claim to the domain?

Titles can't be copyrighted, but if the website with the name of the book is all about the book and capitalizing on the book, then if there was a dispute, ICANN may decide that the domain was registered in bad faith and award it to the book author/publisher.

If it's something like The_DaVinci_Code.com and the site is devoted to Leonardo DaVinci's little known contributions to encryption algorithms and programming code, or if your name is DaVinci and you are a programmer, and your software code is available on your site, then you'd probably be okay.

If it's something like Harry_Potter.com and the site is all about the Harry Potter books, that could be a bad deal.

Context and content surely have something to do with this.
