No, you cannot use somebody else's artwork (in this case, a photograph) without permission.

If you want a picture of an iPod, take one yourself, of your own iPod. If you are wanting a picture of a model or color (or whatever) of iPod to which you do not have access, then you may need to look into licensing arrangements with those who own those pictures.

Naturally, contacting a lawyer about the legalities would be wise.

If you're doing an informational or news web site, check (and read carefully) the media link that the company (in this case, Apple) may have on their web site.

They sometimes will make available publicity images for use in different media. Be sure to read their qualifications and terms of use very carefully to make sure your site qualifies to use the image(s).

If, after reading their terms of use, you have any questions, contact them directly with your questions before using any of their images.

Companies are usually friendlier to deal with when you contact them prior to committing any infringements on the usage of their images than they are afterwards...

Many companies have media kits and other areas of their website just for images. Contact Apple and see their website for images of the iPod. They make the images readily available for you in a variety of formats.

Another possibility is affiliate programs. Many allow use of their product images. Apple, for example, has an affiliate program through LinkShare. I haven't looked into it, but I'd be surprised if they didn't allow affiliates to use certain images, if not all images, in the Apple products area of the Apple web site.
