In a nutshell....

A "freind" of mine owns a web hosting company... At one point, I started my own site under a subdomain, using him as a host.... He bought the actual domain name I wanted (after I made the mistake in telling him my plans) So, I ran the site for about 9 months, got tired of his crappy server crashing all the time, and him just being a jerk...

So I moved my site, everything under a different domain on a different server... I brought along with me the name I used for the site before, as part of my new site...

Now he is ticked, and trying to tell me I am not allowed to use that name, because he owns the domain. From what I am reading here, he has no ground to stand on...

What I would love is actual proof that his threats are nonsence....

Welcome to WebmasterWorld.

I'm not sure we can help you with that proof you need.

The domain name ownership is a key point. Is it registered to you, or to him?

If it's registered to you, it's a much happier situation.
If it's registered to him, you may have a fight on your hands.

Is the name of the company/business registered to you?
If you can prove that you registered the company/business first you will have a head start, although it will still likely be a long and expensive process.

One alternative route is to consider the value in the name that's been built up. If it's not a great deal you could start afresh. If there is a good level of awareness and value in retaining the name, and the profits are there in the long run, you may have to consider fighting for your creation.

In these situations, put your pride to one side and consider that only the Lawyers stand to gain all round in these situtions.

We can't give legal advice at WebmasterWorld, but I'd recommend that you contact your lawyer.
