I am currently in the process of getting a trademark for the name "My Company", including my comapany logo. I have owned the web address www.mycompany.co.uk for about 6 months.

I have found out someone has registered the web addresses www.mycompany.net, www.mycompany.org and www.officialmycompany.com.

As the name "My Company" is my intellectual property, is what this person is doing legal? I found <a website with information> which relates to my problem but it's very long winded!

If someone could give me an explanation in plain enlish it would be very much appreciated!

Basically if your company name is not trademarked anyone can use it. As for being your intellectual property the same applies. I believe you must patent an idea for it to become legally your IP.

To avoid this sort of thing it is recommended that you buy all standard variations of your domain name. ie .com .net .org etc.

Hi,

What do you mean by the process of getting TM? What was the stage of it as you found someone has registered a same name as well? The point is that as far as I know a certain stage of trademarking could give you some priority priviliges and thus you could count on certain legal protection of your alleged rights. Do not take my reply as a competent legal advice but just as a way you could try to solve you problem.
