Several anti-spyware firms, including Aluria, Lavasoft, and PestPatrol, have quietly stopped detecting adware from companies like Claria and WhenU

Claria and WhenU are making the case that their adware programs don't resort to illegal tactics, such as exploiting security holes, to install themselves.

Is the type of advertising that companies like Claria and WhenU are doing illegal (not to be confused with annoying)?

Technically none of it is illegal because it's clearly spelled out exactly what the software does in the terms of service. You know, those things that you keep agreeing to without reading.

Because it's fully disclosed that you are installing adware, there isn't anything illegal about it.
