Does this mean I should stop running apache? (i've had it running for over a year and have not had any problems, then again I mostly use it for development and I do not get very many hits) Sugestions?
Ignoring the TOS problem, you should consider moving the apache server inside a firewall for security reasons. Unless you are experienced and diligent, you may be opening yourself up to hackers.
