Only 19 friends but has my website as URL

We are launching a new site in SEPT-11; and we would like to have the facebook.com/ourdomain URL address. However, someone already has that URL.
He doesn't seem to use FB soo much with only 19 friends an no recent activity. How is the your URL determined via FB and is there a way of getting facebook.com/ourdomain if we have a trademark?

FB allows anyone to claim a custom URL for a business page after they have 25 likes. Your person likely had 25 and had some people leave.

At this point, I would try contacting the FB member and asking for it or offering to purchase it from him. The person could transfer the page to you by making you an admin. You would then remove them as admin and the page and URL would become yours.
