I have a domain name which is "NO Way" similer to a big compnay, but they have big lawyers so they filed the case to get my domain. they have sent the copy of case to my registrar and my registrar has locked the domain and they are saying that untill this case is resolved, my domain will be locked. My registrar also accepts that my domain is no where related to them, but they are helpless saying that "it wil be locked untill both parties resolve it with mutual understanding.
I dont understand how this mutual understanding comes when someone already filed a case. And why there should be any mutual understanding if I am not violating any rule?
Can anyone help me here?
Regards
Tabish
If anyone has personally handled the arbitration process without legal counsel I would be interested to read about your experience.
For those who think the cost of counsel may be astronomical that may be a bad assumption. The comments of at least one lawyer that routinely practices in this area suggest that - in many cases - since he/she has addressed the same process and similar issues many times it is possible to get a semi-canned / semi-customized response filed without great expense.
OTOH, in a more complex and economicially important case "cheap is not the way to go". :)
I have had multiple disputes about domain names in past including one at WIPO,but without my lawyer i dont think i could manage to pass as i did with him.
Did you performed elementary steps, like searched whether if your name is trademarked in USPTO etc?
