Many experts (including me ;))would say that this case wouldn't go much further beyond this point as Microsoft does not have good ground but it does not stop them to intimidate Mr Rove.
It probably going to do more good then harm to Mike overall.

Also we are not talking about just his name. There is already cases that would deal with that like the bruce springsteen case. He would be able to keep the domain.
Lets be honest. He is a web designer. It is rare to associate soft with web design. Soft is usually associated with application development.

For one thing, it sounds stupid for a web design company to have a 'soft' in front of it
but everyone else is too busy comparing other cases with this one, or making fun of Mike's name ;) or re-stating one opinion told a thousand times, in this thread :)
