Using some content from syndicator, there are obvious signs for them to go belly-up soon (site down two days a week, customer service vanished and other clear signals).
How do I handle their content now? Keep up the copyright note and play dumb?

First thing I'd do is print off and save a copy of the TOU and any other agreements related to your use of for the material. Keep this for historial use incase a question about your ability to use the material ever comes up. Second, re-read your agreement and/or the TOU to see if it addresses the situation.
If it doesn't, "keep up the copyright note and play dumb."
