Well it finally happened; I found a site who has pirated one of my Flash animations.

I have discovered that there is a Lithuanian registrar, as well as Network Solutions. They have a .com and a mirror site that is .cz. Besides BetterWhois and SamSpade.org what other tools can I use to get as much information on this company as possible.

I have already emailed them and used every contact for then on their site(s). There is no physcial address, contact name or telephone number anywhere on their network of sites.

This may depend on the country the host is in, but consider having an attorney contact their host.

Yes of course. The host is in Lithuania and there is a mirror of the site with a .cz extension which is Christmas Island.

Their customer service department has responded to my email. I have emailed their host for the owners contact information.

I prefer to give the owner the opportunity to address the issue first, then I get my IP attorney involved as well as file DMCA complaints with Google and their US registrar, all of the directories...is there anyone else I should be contacting?

This appears to be a big company. I know that looks can be deceiving but they have 15 sites in their network and spend alot of money on PPC advertising. It is possible that an employee or a freelance designer is responsibile for this act of piracy.

I am in the business of licensing my work and as my attorney has told me it is not a matter of IF but WHEN my content will be used without my permission. The question is what can I do to turn this into a positive situation?

I'm in business. They are in business. i do everything I can to prevent my work from being copied. This was done by circumventing a technology put into place to prevent downloading and use of the Flash files.

I want to proceed rationally, with a mind towards turning this into a business opportunity. If that is not possible; if I do not get a positive response; then I will swiftly proceed with legal action. Lithuania is a signatore of the Berne Convention but I am not sure if they are one of those countries whose governments do not take action.

Probably yes, that is because of a BAd employee. :-)
