Google refused reinstate my URL, banned because of bogus DMCA report

Guys,
Google has banne dmy URL from serps based on a bogus DMCA report. I have filed a valid reinstatement request from their online form. They replied once asking why they should reinstate my URL. I said because the report is fake and we don't violate any copyrights. I also attached a .doc file with a formal reinstatement request to my reply.

Just got an email from them removals@google.com:

" Hello,
At this time, Google has decided not to take action based on our policies concerning content removal and reinstatement. We encourage you to review [educause.edu...] for more information about the DMCA."

know that by law a content provider (Google) must not interfere in settling the dispute and must restore access if no suit is filed within 10 days.
How should I proceed? Should I try to resolve this nicely with them? Or should I seek legal help? Maybe I should use snail mail or fax to send in my reinstatement request?

Actually you MUST file a Counterclaim and only then if the claimant does not show Google proof of court action then Google MUST reinstate your page(s) (for Google to maintain their safe harbor). Google can certainly ignore their safe harbor meaning you have the right to sue Google who would be colluding with the claimant.

However, if you have never done this before you are best to seek legal assistance before you get in over your head.
