Second Host Sleeps on DMCA Take Down Notice

DMCA Takedown on One Host - Site Moved to New Host

Hi All,

One of our site content was stolen and replicated with changes in to a new site by former employees.

The site was brought down with DMCA take down notice when it was hosted on one host. We filled a Law Suit and Injunction petition in Local Courts in India.

The site was hosted again after few months on another host. I send a mail to this second host's legal team with all details 20 days back and tried to contact them many times for update both via chat and ticket. Every time there will be an excuse and they will say that the legal team will update asap.

Finally I filled a proper DMCA notice which was promptly closed saying there is already another ticket open.

Any suggestions on how to proceed further would help us a lot.

Find out who is providing their servers / rack space and IP connectivity. They may be on a small IP provider connected to a larger one. Contact both. Run a credit check / Better Business / court record search on them. You might see who (lawyer) has represented them in the past. Consult an attorney who specializes in this area and can represent you in the town that they declare as their head office.

See if you can serve them legal papers in person via a service. A strongly worded letter from an attorney might be just enough.

People suddenly react once your actions get closer than they are willing to tolerate.

Just to give an update.

The have finally responded after lot of communications.

We received a counter DMCA and we have served them with Civil Suit and Injunction petitions against the people involved.

Hope to get a final response in next 24 to 48 hours.

Will keep this thread updated so that any future user might benefit.

And as usual they have never respond and the site is still up and running. Now I am getting in touch with Attorneys in Los Angels to represent us.
