My content is copied and my site is penalised

My site content was copy pasted by other site

Hello All,

I have one site ( I can't share the details now ) , some other hobby site guy copied my site content and pasted in his home page after that he got good rankings to his site and my site get penalized.

Kindly help me to get out from penalization and sue the offender .
