Not Happy! Piggy backing on a domain name.

Can anyone offer advice from a legal standpoint in respect of the following problem. I created a site for a client, for arguments sake lets call it wiganwidgets. A competitor has put up a domain called wiganwidgeting, I understand web freedom in business etc. But what has really given me the hump is that they are using wiganwidgets@notmyisp.com as their email address. I really don't want people confusing their site with mine, but this seems to be a deliberate act by the competitor to cash in on my clients site. Is there anything I can do about the email address? Any advice is appreciated. b4b.

IANAL. That said, trademark law covers things "confusingly similar". If you are in the US your trademark does not have to be registered to receive protection.

You might copy the relevant portions of statute and regulation and attach it to a C&D letter just to see what happens. If that doesn't work, then you would have to seek qualified legal advice.
