Is Google correct or is this a case of a Google employee responding to a request because it was submitted by a government official?

Francke added that if the documents are indeed copyrighted, the posting by the blog of the pay stubs would qualify as a “fair use” - meaning it would pass legal muster - because there is no market value lost by the publication.

Google may have intended to limit any liability by removing the material. Whether right or wrong is probably a matter for the courts.
