picture usage myspace style, is it legal?

I am in the process of creating a site with a sports niche and it will be social network/user content driven and im wondering if a user uploads a picture of a tennis player and creates a profile if thats illegal? For instance in myspace if you type in Bam Margera you will see a ton of his profiles and pics. Our site will be similiar and just looking for some input?

It would be legal if he is the tennis player himself I guess.

Sometimes a picture will be placed in the public domain or licensed for use by the copyright holder. This may be for marketing / journalistic purposes. But be careful, people like to claim this even when it's not remotely true!

i imagine as long as i put a link or notification that states we will remove any image/content if its in violation immediately that should help. Maybe ill put it in the tos, privacy policy or terms page. thanks
