Ruling: Linking Not Permitted if Other Site Objects

Here we go again with another ruling [news.com.com] on whether it is legal to include links if other site doesn't want the links. Specific to webcasting but may also apply to any copyright material. Long way to go before this thing is resolved.

This particular case was found to violate copyright because the content was being accessed from the linker's site through the link, so it makes sense in that regard.

...so it makes sense in that regard.

How so? Seems what the plantiff doesn't like is that their own link to the webcast has ads surrounding it where the defendent's link does not. How does this differ than if, say, I have a link to a video clip from a news site in blog that says" "See the report here"? By link I assume that is all there is, a link that takes someone to content on the linked site.
