Lets say I wanted to put a news video about George Bush on my site.

A 60 second video of me talking. This would include 10 seconds of CNN video footage showing an interview between CNN & George.

The 10 second CNN footage would have been captured from a streaming video on the CNN website.

Can I do that & is CNN going to sue me for copyright infringement?
How would you cover your a**?
What's classified as fair use in the online video world?

We can't offer legal advice here. What you are suggesting might well fall under the fair use guidelines, but you could request permission if you wanted to be sure. Check out this forum's Charter [webmasterworld.com] for some good links, including Chilling Effects.

Are you critiquing the CNN coverage? Or are you using them as visual filler? Or to provide something that you can't? (An interview with George Bush.)

Forget the legalities for a moment. Ask yourself if it's right.

Yes, I would be looking to use original CNN material as visual filler.

Same idea as if I had a 60 sec video about the future of local search & I used a 10 sec CNN clip of Eric Schimdt's views on the topic.

Is it "right"? Dunno, thats why I'm asking. I would say yes - probably.

Assuming that all credit is given to the source (CNN for eg) & I'm not ripping them off - in my opinion, my understanding is that this would fall under "fair use".

Look at how often TV stations broadcast footage from another TV station's cameras. Anyone know if the latter get paid if the other stations' footage is used? The answer to the TV question is the answer to mine.....
