Images Submitted by Users

I am developing a site right now that will allow users to submit images to the site in two ways.

1) Uploading it to my server
2) Submit a URL of the image from their own server and my site will just parse to be visible in my page. This second option is like posting image here in the forum

Will I be responsible for this if they submitted a copyrighted image and the user has no ownership or rights on the image?

What if users host it in their own server and I will just generate their page in my site? Like how vbulletin and phpbb does it. Will i still be responsible for that?

Define "responsible"...

The DMCA gives you certain protections, provided you meet certain criteria and follow certain guidelines. You are ultimately "responsible" from the standpoint of being required to take-down copyrighted material upon notification.

Read-up on the DMCA, and talk to an attorney.
