a site that copied my content is not cached

is it possible to run DMCA against them?

OK, so we made some more checks after we found yahoo answers feature copied text from us.

now, we found something else. someone made a network of scraper sites. they basically copy everything and put adsense around.
i emailed adsense to ban them for life as i thought it would be best to stop the guy doing it.
adsense replied saying that we need to file a DMCA and then notify them.

the problem here is that network mentioned above. basicaly, the guy has one website cached (40k+ cached pages), where he puts snippets of stolen texts with links to his non-cached websites featuring full articles stolen.
the DMCA request requires to give cached page of the page featuring copied materials. with the cached pages it is easy - file a DMCA showing snippets on cached pages.

now, what with the non-cached pages?
this is obviously agains adsense TOS but is it possible to run a DMCA against non-cached pages?
on one hand they are not cached in google, so it is impossible to run DMCA against them, on the other hand they have adsense around them.
