I am going to try to enforce only first hand experiences with factual details only.
My question is.. well that's not it. I know they would try to come after me.
My other question is what else would you do, to make sure I am not violating copyrights, nor am I considered libelous?
Maybe a login screen with appropriate disclaimers, which makes you check a box each and every time?
* One: You need to get competent legal advice.
* Two: This is the sort of information that should have been investigated and costed in a Business Plan long before development.
* Three: It reads like you will be running a "forum" for people other than yourself to post. There is no practical way to really know from whom and from where a post originates. There is no real time way to confirm no copyright infringement, libel concerns, etc. - so in comes pre-moderation and lots and lots of time trying (no guarantee) to minimise liability.
* Four: The burden of proof (especially regarding libel) can vary from jurisdiction to jurisdiction. Although you can specify the jurisdiction where any legal action is to occur that may be ignored. Can you afford to answer a challenge from half-way around the world? Due to international agreements a foreign courts decision might very well be automatically enforced by your own.
* Five: These questions are for thought, not response: What standards of "proof" thresholds have you incorporated? How will/can you enforce them? How do you plan to handle a "target's" denial and request for apology and removal; for damages? Who do you believe (most posts will likely be he-said/she-said without actual physical "proof") and why? Should you face a major judgement can you afford the loss: and what is there to lose?
* Six: Just prefacing info with a notice that you aren't responsible and putting it behind a log-in is like repeating something behind a closed door while declaiming not to know its validity: rather flimsy defence imo. Especially if the info is indexed in SEs for all the world to view. And if it isn't how will you derive your traffic?
* Seven: You need to get competent legal advice.
I would expect hoards of traffic. Great idea: the tabloids have profited greatly from the same business model. They, however, have deep pockets and a large legal staff.
