Overture Trademark Question

I read through the [searchmarketing.yahoo.com...] but still had a question.

1. In Google, you can bid on a trademarked term (most of them) but not use the word in your ad. Very straightforward unless you want to take it to court.

2. In Overture it is very straightforward to me that certain companies may bid on a trademark term under certain circumstances.

3. My question is, can those same advertisers in Overture that bid on a trademarked term put that term in their ad text per Overtures policy.

Please remember, I just want to understand what Overture's current policy is not whether something is legal or illegal. If you do know the answer to that and it is listed in the trademarks.php can you list the section that has the information or point me toward how you are basing your info.
