we are in the process of starting to sell a product to america. Its a small item so kids could swallow it, (its got nothing to do with kids though).
Now reading those news stories (the infamous hot coffee at a restaurant didnt had a warning hot coffe has hot coffe in) and hollywoods movies with lawyers makes me wonder, first is it really that bad in the USA that you get sued for anything to absurd amounts? And second whom would i contact in the states to make the warning text on the package water proof (well up to a certain point i guess)...

Contact a lawyer specialized on liability law for the warning text and get some insurance to cover any damages from your products. This is something you should do regardless of were you selling. You should also make sure that the product conforms to the products safety regulations of the country you are selling to.
