Two sites that I manage that are well established, full of original content, seo'd, but not at all spammy and they are excluded from results.

They must be indexed, since I see plenty of back links, but the sites do not show for domain, or title.

I would rather see a new search engine filter-out results over time then start out with "top sites" excluded or penilized.
