Naturally, however, you have no contract with FedEx - your contract is with the merchant. If you make a claim against FedEx, you might be shooting yourself in the foot by accepting the merchant isn't liable. Late last night the vendor told me to file a claim with FedEx.
You should definitely talk to your credit card company first.
