This penalty seems to be aimed at G's PPC advertiser activities. What about their SERP's?

So if sites like The Pirate Bay (who are essentially a search engine like google) are having their owners held accountable for information they present to the public, does that mean that the serps should be held in the same light as the sponsored listings?
