I don't think that could be considered spam in and of itself, but how are you planning on using it? If you're going to use it for spammy purposes, then you can pretty much count on getting a manual penalty sometime or other as soon as one of your competitors reports you to Google...

But there are many legitimate uses for overflow:hidden as well, which shouldn't trigger a penalty.
