I know that it cgi script links because a first the cgi link was showing instead of index page, then the sites got dropped. Later they returned only with the index page showing and without the ability to rank. For example searching for any keyword phrase the site would always be ranked last. I noticed the same problem happen to hundreds of other sites. I told the people at Yahoo about this in March of 2004, I am just surprised that it is taking so long to get resolved.
To answer your question yes you could get your competition banned. In fact I was joking that if Google linked to Yahoo in this way Yahoo would end up banning itself. Just something to think about for April 1st for Googleguy.
