As to litigation: In an effort to meet some more top SEO types, I attended a conference in April sponsored by ccbill. As to your proposal: So what would the "little guy" be willing to do. imho - there are at least 2 types of "little guys" It would be interesting to hear what the latter group had to say.
As to lobbying:
The casino industry, in the past, has been successful in throwing money at this and deferring legislation that would effect their industry. They can afford it.
The brick & mortar video industry did an effective job litigating zoning ordinances, etc. They banned together location by location and it cost them money to do it.
At that conference an attorney made an impassioned plea to form an organization to lobby/litigate what he felt would be a real threat from the current administration. I checked with a source this morning and that plea has gone nowhere to the best of his knowledge.
In short, it takes money to gain access to the political process.
Litigation might be obtain on a contingency basis. There are a lot of dot com legal firms in your area who's revenue might has been hurt by the recent meltdown.
Those with NO money and those with at least $1000 in working capital.
