If Google eyes are looking at your site they reserve the right to adjust it manually or algorithmically so it's always a risk to draw the attention of those eyes, imo.

If you know you have a penalty there is more to gain than lose, just be sure it's a penalty first. Panda's bite can be worse than a penalty.
