Would you use it as a 'tie-breaker' or as a signal of 'non-quality' when a site is 'super-slow' comparative to other results, or maybe both?

I ask, because couldn't it be only 1% of queries are effected, because if sites are in the 'relative speed' or 'acceptable speed range' of the sites they are competing against it's a non-factor and the reason only 1% of queries are effected is because there are only enough sites with a low enough load speed to trigger a 'distinct and obvious lack of speed' filter for 1% of the queries done?
