We got hit by this "page 4 - 40+ serp penalty" last november. We have done absolutely everything possible to recover. No matter what we search for, even our unique copyright statement we appear at the back of the SERP's behind a bundle of scrappers either plugging RSS feed data or simply downloading and duplicating the entire site. For what it's worth we are a PR 8 and have been for over a year - go figure!
