Several categories of material are generally not eligible for federal copyright protection. These include among others: If they are scanning books of works that are in the public domain, then I don't see where the problem is. Like I have said before, I would not bet against Google on a copyright issue. I have no doubt that they run through all the possible issues with real experts long before we ever hear about a product.
