As others have suggested in this thread, is it possible that things like the number and quality of inbound links is essentially causing Google to say "Okay, they may be over-optimizing here but it is obvious from the value and number of links they have that this site is the most relevant for [keyword/phrase]. So in this case - where there may be some doubt, and we certainly don't want to hurt a site w/o being sure they are doing wrong - let's not penalize them."
