A couple of points.

-- I think (IANAL) a lot of it might be subject to prior art, specially since these techniques are fairly generic and have been discussed ad nauseum in several public areas.

Frankly speaking, I am surprised they forgot to mention that spammy websites are likely to not have a customized favicon and common favicon's across sites can reveal networks.
