If you have a JavaScript menu and have a NOSCRIPT tag with approximatly the same content in it I would not take issue with it.
The purpose of the NOSCRIPT tag, as the W3C defined it (I'm paraphrasing) was to enable a delivery of 'similiar' content to that inside the SCRIPT tags for browesers that do not support JavaScript (or ECMAScript if you prefer).
