Page is a not externally linkable

If content is king then how can this happen. It looks far more like link text is king. Any words of wisdom from the experts?
With regard to the topic of this thread "Reporting bad search results" I reported the number 1 site in our main search results yeaterday as this site has been showing just one page that says "this site is temporarily unavailable" for 6 months and yet continues to rank #1 both pre Florida and post Florida. Even the Google description tag shows the "not available" phrase.
