Where are you and your site-jacker based? Could have some significant bearing on this. What I don't understand is if one or the other party is based in one or the other region which law applies?
My basic understanding of copyright (which could easily be very wrong) is that in the US you apply for it. In the EU it is automatically given even without the little ©. Elsewhere ???
