Ask Jeeves and About.com do this, and I don't think either has been sued. Why? Probably two reasons: 1) Adding a few lines of framebreaking code is easier (and cheaper) than filing a lawsuit. 2) Many Webmasters put up with frames in return for the traffic they get from referrers like Ask Jeeves and About.com.
