There is a difference between fact and opinion. And there is such a thing as a false fact. ("The things you do know that ain't so.")
"the food was lousy" = opinion, rarely actionable
"there were lice in my salad" = statement of fact, either true or not true, probably actionable if not true
"rarely" and "probably" = depends on jurisdiction, as does burden of proof.
