Agreed. That's where the "over-the-top" network management issue comes in. If you're allowd up to 16Mbps and you're using 16Mbps -- you're golden. Of course not. If you're within the bandwidth limits you signed up for, the ISP is wrong for capping.
Doesn't matter what I'm doing with my service, I'm paying for a set range so that's what I expect. They shouldn't cap bandwidth because you actually USE what you are paying for either.
