Bad Links from Bad Neighborhoods

Hi I've just been testing my site using the "www.mysite.com" to check for penalties, and who links to my domain name and unfortunately have found a link from a site which buys/sells links.

Obviously somebody has added my link in the hope of shooting me down in the SE's and I want to get this inbound link removed.

I dont have any penalties of note at the moment, but have been working extremely hard to get my site higher but to no avail..so Im thinking I may have a slight dampening penalty/factor that may be affecting my rankings.

Bottom line is how do I tell google not to take into account the link from the spam site?

A lot of people are paranoid about this, but I'm going to go out on a limb here and say a link from one shady site would have no effect on your rankings.
